High school football player accused of rape released from jail

McALESTER — An 18-year-old McAlester High School football player charged with having sex with a 13-year-old has been released from jail.

Joshua Andrew Peckio, 18, of McAlester, was charged Jan. 7 in Pittsburg County District Court with four counts of first-degree rape. He had been held at Pittsburg County Jail since his arrest.

Peckio was a starting lineman with the McAlester Buffalo football team.

He was released from jail Thursday after his bail was reduced from $150,000 to $20,000, according Peckio’s attorney, Pat Layden.

Court documents filed in the case state that as a condition of Peckio’s bond, he is to have no contact with the alleged victims or their parents. He was also ordered not to be alone with children under the age of 18.

According to a court affidavit filed in the case, Peckio was charged after police were notified of the allegations in November by a church youth pastor. The affidavit states the alleged victim wrote a note to her friend stating that she “was scared she might be pregnant.” The note was found by the friend’s parent and a family member of the alleged victim was notified.

The alleged rape was reported to police in November by a church youth pastor.

The alleged incidents of rape allegedly occurred in October while Peckio was living away from home.

On Monday, Peckio’s attorney Layden said Peckio will not be returning to McAlester High School.

“He’s going to finish his high school and attend college in a different location,” Layden said.

A preliminary hearing is set for the case on Jan. 31, at 9 a.m.

If convicted of the charges against him Peckio faces up to 60 years in prison.
