Smith’s co-defendant in the case, Heath Pitts, 36, of Hartshorne, pleaded guilty May to charges of conspiracy to commit a felony and grand larceny. On June 8, he received a five-year sentence, with all but the first 45 days suspended.

According to court records, Pitts and Smith stole $2,318.37 from the Hartshorne Sonic drive-in restaurant.
