No charges filed in deadly Eufaula boating accident

McALESTER — No charges had been filed late Tuesday, a day after a McAlester man turned himself in as the pilot of a boat that crashed on Lake Eufaula on July 4, sending two children to the hospital and leaving one man dead.

Ryan Shumway, 30, turned himself into the McIntosh County District Attorney’s office on Monday, the Oklahoma Highway Patrol reported. 

Shumway’s attorney, William Gotcher, of McAlester, said Tuesday he had no comment about the case. No one answered the phone or the door at his home.
Shumway turned himself in Monday, two days after  officials found the body Gary McIninch, 55, of Oklahoma City in Lake Eufaula.  McIninch had been missing since the July 4 boat wreck involving three watercraft.
On Monday, the OHP reported Shumway was aboard a 1999 Crownline ski boat with three passengers, including Janai Shumway, 32, and two children, ages 10 and 8, all of McAlester.
McIninch had disappeared into Lake Eufaula on July 4 after he was ejected from a pontoon boat that was hit by a 20-foot ski boat traveling at an estimated 30 miles per hour, witnesses told police.
After hitting the pontoon, which had been carrying 10 people — including five children — the ski boat landed atop a nearby Stingray boat that had four people on board.
McIninch and the children had been on the pontoon boat at the time of the wreck.
Witnesses told OHP the driver of the ski boat circled around and asked if everyone was okay and then left the scene.
Two children were injured in the accident. A 6-six-year old girl suffered a head injury and 7-seven-year- old girl suffered a leg injury. Both were flown by medical aircraft to OU Medical Center and since been released, hospital officials said Tuesday.
