DA still investigating deadly July 4 boating accident on Lake Eufaula

McALESTER — Officials say they are still investigating a deadly July 4 hit-and-run boating on Lake Eufaula involving a McAlester man.

One man died and several others were injured after McAlester resident Ryan Shumway allegedly drove his boat into a pontoon boat full of people on Lake Eufaula, according to a report by the Oklahoma Highway Patrol.

Although no charges have been filed, the investigation continues, according to District 25 District Attorney Rob Barris.

“Our investigator spoke with Shumway as early as today,” Barris said Thursday.

“We’ve also been in contact with the family of the victim to discuss the ongoing investigation.”

Gary McIninch, 55, died after he was ejected from a pontoon boat that was hit by a 20-foot ski boat allegedly piloted by Shumway, according to a report by the OHP.

McIninch’s body was found in the water two days after he disappeared into Lake Eufaula, officials say.

The report states Shumway told police he was traveling at about 30 mph when he hit the vessel.

Four days after the accident, Shumway came forward to investigators through his attorney and made himself and his boat available to investigators.

A medical examiners report released in January revealed that McIninch died from complications of blunt force trauma of the torso, that he had lacerations to the scalp, fractures of the rib, vertebrae and spinal cord transection.

The type of death is listed as “violent, unusual or unnatural.”

Meanwhile Barris said the investigation is ongoing.

“We have requested additional information and we are waiting for that before  I make a decision on the charges.”
