Sept. 28, 2009 - Pittsburg County District Court Dispositions

The following felony cases were decided in Pittsburg County District Court Sept. 15-22. Dispositions include dismissed cases, suspended and deferred sentences, and sentences from trials and plea bargains.

• Stephen Michael Garland, 36 of McAlester, pleaded guilty Sept. 22 to possession of a controlled substance, marijuana, and misdemeanor domestic abuse assault and battery and possession of drug paraphernalia. He was sentenced to drug court and was assessed a $4,500 drug court fee. Garland was charged with the prior conviction enhancement for a 2005 drug case resulting in a 10-year suspended sentence.

• Garland also pleaded guilty Sept. 22 to an application to revoke a suspended sentence and was sentenced to drug court. The remainder of his 10-year suspended sentence is to remain in effect. That suspended sentence was from a 2005 guilty plea to charges of possession of a controlled drug, methamphetamine, and misdemeanor possession of drug paraphernalia.

• Derrick Wayne Bibbs, 37, of Haileyville, pleaded guilty Sept. 18 to two counts of attempting to obtain controlled substance by fraud. He was sentenced to five years and another 28 counts of the charge were dismissed.

• A charge of possession of a controlled substance, methamphetamine, was dismissed Sept. 18 for Ervin Ray Smith, 49. The charge had been filed with the prior conviction enhancement for a 2004 drug case in Haskell County.

• Patrick Joseph Sellner, 50, of Hartshorne, was found guilty by a jury Aug. 18 of assault with intent to kill and was sentenced Sept. 22 to five years, as recommended by his jury.

• Glenn Peter Eubanks, 52, of McAlester, pleaded guilty Sept. 18 to possession of a controlled substance, cocaine, and misdemeanor domestic abuse assault and battery and possession of drug paraphernalia. A five-year sentence was suspended, to be served concurrent with sentencing in two other cases, and he was ordered to complete 52 weeks of domestic abuse counseling. Eubanks was charged with the prior conviction enhancement for a 2007 drug conviction resulting in a five-year deferred sentence.

• Kenny Norris Sweetin, 28, of Hartshorne, pleaded guilty Sept. 18 to second degree burglary and a five-year sentence was suspended. He was also ordered to pay $817.50 in restitution. Sweetin was charged with the prior conviction enhancement for a 2006 drug case in Atoka County.

• Amy Gail Heathcock, 26, of McAlester, pleaded guilty Sept. 18 to misdemeanor obstructing officer. A one-year sentence was suspended, to be served concurrent with sentencing in another case. A felony charge of assault and battery upon police officer was dismissed.

• Tommy Edward Collins, 37, of Hartshorne, pleaded guilty Sept. 18 to obtaining controlled substance by fraud, Soma and Xanax, and attempt to obtain controlled substance by fraud, Soma, and alprazolam. A four-year sentence was suspended.

• David Anthony Turner, 18, of Quinton, pleaded no contest Sept. 15 to second degree forgery and judgment and sentencing were deferred for five years. He was also ordered to pay $175 in restitution.

• A bogus check charge was dismissed Sept. 15 for Judy Williams.

• A bogus check charge was dismissed Sept. 15 for Johnny Webster, of Wagoner.

• Cherrie Storey, 34, of McAlester, pleaded guilty Sept. 15 to embezzlement and a six-year sentence was suspended. Storey had been charged with the prior conviction enhancement for a 2000 case alleging child neglect and drug offenses that resulted in a suspended sentence.



The following misdemeanor cases were decided in Pittsburg County District Court Sept. 14-23. Dispositions include dismissed cases, suspended and deferred sentences, and sentences from trials and plea bargains.

• A bogus check charge was dismissed Sept. 23 for Victoria Workman, 23, of McAlester.

• Michael C. Hebert, 36, of Basile, La., pleaded guilty Sept. 22 to driving a motor vehicle while under the influence of alcohol and failure to move to a non-adjacent lane when passing emergency vehicle. Judgment and sentencing were deferred for one year and he was fined $500. He was also ordered to attend DUI school and a Victim's Impact Panel.

• Joshua R. Day, 19, of McAlester, pleaded guilty Sept. 21 to malicious injury to property valued at under $2,500 and judgment and sentencing were deferred for one year. He was also fined $100 and was ordered to pay $250 in restitution.

• Michael W. Sauls, 49, of McAlester, pleaded guilty Sept. 21 to trespassing after being forbidden and judgment and sentencing were deferred for six months.

• A bogus check charge was dismissed Sept. 21 for Marilyn Sue Carrion, 39, of McAlester. Restitution has been paid in full.

• Randy Dale Davidson, 61, of rural Hartshorne, pleaded no contest Sept. 21 to driving with license suspended, failure to maintain security and altering license plate or decal. A one-year sentence was suspended and he was fined $210.

• Brandon Lee Brown, 18, of Eufaula, pleaded guilty Sept. 21 to larceny and a one-year sentence was suspended, to be served concurrent with sentencing in another case. He was also ordered to pay $19.50 in restitution.

• Daniel Martin Paul, 20, of McAlester, pleaded guilty Sept. 21 to public intoxication and he was fined $10.

• Shannon Laraine Smith, 27, of McAlester, pleaded guilty Sept. 21 to public intoxication and was fined $10.

• Michael W. Watkins, 20, of McAlester, pleaded guilty Sept. 18 to domestic abuse assault and battery and judgment and sentencing were deferred for two years. He was also fined $100 and restitution in the case was reserved. He was also ordered to complete 52 weeks of domestic abuse counseling.

• Glenn Peter Eubanks, 52, of McAlester, pleaded guilty Sept. 18 to driving a motor vehicle while under the influence of alcohol, driving with license suspended, failure to maintain security, improper left turn and obstructing driver's view. A one-year sentence was suspended, to be served concurrent with sentencing in two other cases. He was also ordered to attend DUI school and a Victim's Impact Panel.

• Amy Gail Heathcock, 26, of McAlester, pleaded guilty Sept. 18 to driving with license suspended and speeding. A one-year sentence was suspended and she was fined $100 on the license charge and was ordered to pay the scheduled fine for speeding. The sentencing was ordered served concurrent with sentencing in another case.

• Rhonda Renee Channon, 43, of McAlester, pleaded guilty Sept. 18 to public intoxication and she was fined $10.

• Randall Tad Bowden, 25, of Hartshorne, pleaded guilty Sept. 17 to driving with license suspended and he was sentenced to 10 weekends in the county jail, with the remainder of a one-year sentence suspended. The sentence was ordered served concurrent with sentencing in two other cases, and he was fined $300.

• Jerry Don Bowen, 20, of Indianola, pleaded no contest Sept. 16 to possession of a controlled substance, marijuana, and failure to wear a seat belt. Judgment and sentencing were deferred for one year and he was fined $100.

• A charge of transporting opened container of beer was dismissed Sept. 16 for Jared Keith Cruce, 28, of Newcastle.

• Leon Lance Lyles, 42, of rural Stigler, pleaded no contest Sept. 16 to transporting opened container of beer and he was fined $50.

• Wendey Marie Hill, 61, of Eufaula, pleaded guilty Sept. 16 to careless driving and she was fined $50.

• Brian Hernandez, 22, of McAlester, pleaded no contest Sept. 16 to public intoxication and he was fined $10.

• Tommy V. Ellis, 39, of rural Kiowa, pleaded guilty Sept. 16 to possession of illegally taken whitetail deer and he was ordered to pay the scheduled fine.

• Jerry Don Paxton, 28, of McAlester, pleaded guilty Sept. 16 to possession of illegally taken whitetail deer and he was ordered to pay the scheduled fine.

• Tammy Wilhelm, 24, of McAlester, pleaded guilty Sept. 16 to public intoxication and she was fined $10.

• A bogus check charge was dismissed Sept. 15 for Shirley Spence, of McAlester.
