Sept. 6 2009: Pittsburg County District Court Dispositions

The following felony cases were decided in Pittsburg County District Court Aug. 27-28. Dispositions include dismissed cases, suspended and deferred sentences, and sentences from trials and plea bargains.
• Travis Lynn Mayo, 24, of McAlester, pleaded guilty Aug. 28 to placing bodily fluids on officer and a two-year sentence was suspended, to be served concurrent with sentencing in two misdemeanor cases. He was also fined $500 and was ordered to obtain 52 weeks of domestic abuse counseling.
• Elbert Ray Weeden, 57, of rural McAlester, pleaded guilty Aug. 28 to driving a motor vehicle while under the influence of alcohol, and misdemeanor driving with a suspended license and transporting an open container of liquor. A five-year sentence was suspended and he was fined $800. He was also ordered to attend a Victim’s Impact Panel and DUI school, obtain and comply with the recommendations of a drug and alcohol abuse evaluation, attend Alcoholics Anonymous, and comply with any aftercare as directed by Probation and Parole. The charge was filed with the prior conviction enhancement for a 2001 misdemeanor drunk driving case resulting in a one-year suspended sentence.
• Beverly K. Evans, 53, of McAlester, pleaded no contest Aug. 28 to possession of a controlled substance, Oxycontin, and guilty to misdemeanor charges of driving while her license is suspended, possession of drug paraphernalia, failure to maintain security, and driver’s license to be carried. She was sentenced to six years, with another four suspended, to be served concurrent with sentencing in two felony cases. A misdemeanor charge driving a motor vehicle while under the influence of drugs was dismissed. The case was filed with the prior conviction enhancement for a 2004 forgery resulting in a seven-year sentence, with another 13 years suspended; and another 2004 forgery case, also resulting in a seven-year sentence, with 13 years suspended.
• Courtney Charles Hammers, 26, of rural McAlester, pleaded guilty Aug. 28 to second degree burglary and misdemeanor obstructing an officer. A seven-year sentence was suspended and restitution in the case was reserved. Hammers was also ordered to obtain and comply with the results of a drug and alcohol abuse evaluation, and complete six months of drug rehabilitation within nine months.
• Tory Evans Barfield, 32, of Tulsa, pleaded guilty Aug. 27 to possession of a controlled substance, heroin, and misdemeanor possession of drug paraphernalia. He was sentenced to four years, with another six years suspended, and he was fined $1,200, with another $9,000 in fines suspended. The charge was filed with the prior conviction enhancement for a 2005 case in Dallas County, Texas, for felony marijuana possession resulting in a three-year deferral that was later revoked for 18 months.
• George Neal Hall, 48, of rural McAlester, pleaded guilty Aug. 27 to possession of a controlled substance, methamphetamine, and misdemeanor possession of drug paraphernalia. He was sentenced to 10 years, to be served concurrent with sentencing in another felony case. He was charged with the prior conviction enhancement for a 2001 drug sentence of three years, with another seven suspended; a 2007 drug sentence resulting in a 10-year suspended sentence, of which three years were later revoked; and another 1997 drug sentence of 10 years.
• Chance Ethan Oswalt, of Tulsa, pleaded no contest Aug. 27 to possession of a controlled substance, heroin, and misdemeanor possession of drug paraphernalia and judgment and sentencing were deferred for three years.
• Karly Autum Bookout, 18, of McAlester, pleaded guilty Aug. 28 to second degree burglary. Judgment and sentencing were deferred for three years and a charge of knowingly concealing stolen property was dismissed.
The following misdemeanor cases were decided in Pittsburg County District Court Aug. 25 to Sept. 2. Dispositions include dismissed cases, suspended and deferred sentences, and sentences from trials and plea bargains.
• William Ray Pierce, 31, of McAlester, pleaded no contest Sept. 2 to domestic abuse assault and battery and was sentenced to one year, to be served concurrent with sentencing in two felony cases and one misdemeanor case.
• Pierce also pleaded guilty Sept. 2 to public intoxication and was sentenced to 30 days, to be served concurrent with sentencing in two felony cases and one misdemeanor.
• A charge of driving a motor vehicle while under the influence of alcohol was dismissed Sept. 2 for Dana Jolynne Rogers, 47, of Eufaula.
• Jose Marco Martinez, 21, of Seminole, Texas, pleaded guilty Sept. 1 to public intoxication and he was fined $10.
• Karly Autum Bookout, 18, pleaded guilty Sept. 1 to driving without a driver’s license. She was fined $50.
• Sarah Beth Blankenship, 31, of Alderson, pleaded guilty Aug. 31 to driving a motor vehicle while under the influence of alcohol. A one-year sentence was suspended and she was ordered to attend DUI school and a Victim’s Impact Panel, and obtain a drug and alcohol abuse evaluation within 60 days.
• Kevin Gene Key, 41, of rural McAlester, pleaded guilty Aug. 31 to public intoxication and was fined $10.
• A charge of distribution of imitation controlled substance was dismissed Aug. 31 for John Walter Gasowski Jr., 38, of McAlester, because it was in the best interest of justice.
• A charge of driving while his license is suspended and assault and battery was dismissed Aug. 31 for Aric Lee Griffeth, 24, of Wilburton.
• A charge of assault and battery was dismissed Aug. 31 for Clinesha Michelle Richardson, 29, of Hartshorne.
• Travis Lynn Mayo, 24, of McAlester, pleaded guilty Aug. 28 to malicious injury to property valued at less than $2,500, domestic abuse assault and battery, and trespassing after being forbidden. A one-year sentence was suspended, to be served concurrent with sentencing in one felony and two misdemeanor cases, and restitution in the case was reserved. He was also ordered to obtain 52 weeks of domestic abuse counseling.
• Mayo also pleaded guilty Aug. 28 to assault and battery and a 90-day sentence was suspended, to be served concurrent with sentencing in one felony and two misdemeanor cases.
• Mayo also pleaded guilty Aug. 28 to a protective order violation and judgment and sentencing were deferred for three years. The sentencing was ordered concurrent with sentencing in another misdemeanor and felony case. He was also fined $500 and he was ordered to complete 52 weeks of domestic abuse counseling.
• Andrew F. Soria, 22, of McAlester, pleaded guilty Aug. 28 to obstructing an officer, driving without a valid driver’s license, and failure to pay taxes due to state. A one-year sentence was suspended and he was fined $250.
• Stephana Lynne Carter, 24, of Indianola, pleaded guilty Aug. 28 to larceny of merchandise from retailer and a 30-day sentence was suspended. She was also fined $250.
• Angela McClain, 42, of Stuart, pleaded guilty Aug. 28 to public intoxication and she was fined $10.
• Teresa Rene Holt, 46, of Hartshorne, pleaded guilty Aug. 28 to driving while her license is suspended and a one-year sentence was suspended. She was also fined $200.
• A protective order violation was dismissed Aug. 28 by Keith Paul Davis, 42, of McAlester.
• Billy Francis Jones, 56, of McAlester, pleaded guilty Aug. 28 to driving with license suspended and failure to devote full attention to driving. Judgment and sentencing were deferred for two years and he was fined $200.
• Misty Lynn Bingham, 28, of rural McAlester, pleaded guilty Aug. 28 to transporting an opened container of beer and failure to wear a seat belt. Judgment and sentencing were deferred for six months and she was fined $100 on the open container charge and was ordered to pay the scheduled fine for the seat belt violation.
• Gerald H. Valenta, 36, of rural McAlester, pleaded guilty Aug. 28 to transporting an opened container of beer and judgment and sentencing were deferred for six months. He was also fined $100.
• David Waldron Sr., 50, of Alderson, pleaded no contest Aug. 27 to dumping trash on public or private property. He was fined $200.
• A charge of trespassing after being forbidden was dismissed Aug. 27 for Marcus Eaver, 36, of McAlester. Eaver is in prison.
• Adrian Burl Carter, 61, of McAlester, was found guilty at a non-jury trial Aug. 27 of driving without a driver’s license, failure to carry insurance or a security verification form and failure to signal on turning. He was fined $110.
• A charge of driving in a manner not reasonable and proper was dismissed Aug. 26 for Thomas Jackson Welch, 50, of Texhoma.
• A charge of driving without driver’s license was dismissed Aug. 26 for Jose Manuel Calvillo, 24, of Fort Smith, Ark.
• Freddie M. Weeden Jr., 46, of rural McAlester, pleaded no contest Aug. 25 to aggravated driving a motor vehicle while under the influence of alcohol, driving with a suspended license, transporting an open container of beer and failure to carry insurance verification. He was sentenced to one year and was fined $800. He was also ordered to obtain and comply with the recommendations of a drug and alcohol abuse evaluation, attend a Victim’s Impact Panel and DUI school, and use an interlock device.
• Christopher Stanfield, 39, of Quinton, pleaded guilty Aug. 25 to transporting a loaded firearm in a motor vehicle, transporting an opened container of beer, public intoxication and failure to wear a seat belt. A six-month sentence was suspended.
• Cody Richard McQuay, 22, of McAlester, pleaded guilty Aug. 25 to possession of a controlled substance, marijuana, possession of drug paraphernalia, driving with a suspended license, and transporting an open bottle or container of liquor. A one-year sentence was suspended and he was fined $400. Charges of failure to pay taxes due to state and failure to maintain security were dismissed, and McQuay was ordered to obtain and comply with the recommendations of a drug and alcohol abuse evaluation.
• Terry Phillip Daniels Jr., 31, of Kiowa, pleaded guilty Aug. 25 to aggravated driving a motor vehicle while under the influence of alcohol, eluding police officer, transporting an opened container of beer and malicious injury to property valued at less than $2,500. A one-year sentence was suspended and he was fined $800. He was also ordered to pay $250 restitution, obtain and comply with the recommendations of a drug and alcohol abuse evaluation, obtain 28 days of in-patient treatment, and attend DUI school.
• Garrison Irvin Joslin, 26, of McAlester, pleaded guilty Aug. 25 to driving with a suspended license and a one-year sentence was suspended.
• Carmen Millard Johnson, 25, of McAlester, pleaded guilty Aug. 25 to attempting to elude police officer, driving with a suspended license, failure to stop at a stop sign and speeding. A one-year sentence was suspended and Johnson was fined $450 and was ordered to pay the scheduled fine for speeding. A charge of failure to carry insurance or a security verification form was dismissed.
• Frederick Moses Ahhaitty, 59, of McAlester, pleaded guilty Aug. 25 to transporting an opened container of beer and public intoxication. He was fined $100.
• Jerrod Dewayne Hunter, 26, of Keota, pleaded guilty Aug. 25 to driving with a revoked license and a one-year sentence was suspended.
• Jackie Wayne Maness, 52, of McAlester, pleaded guilty Aug. 25 to obstructing an officer and a one-year sentence was suspended.
• Jerry Carl Owens, 52, of McAlester, pleaded no contest Aug. 25 to aggravated driving a motor vehicle while under the influence of alcohol and failure to keep to right. A one-year sentence was suspended and he was fined $600. He was also ordered to obtain and comply with the recommendations of a drug and alcohol abuse evaluation, attend DUI school and a Victim’s Impact Panel, attend meetings of Alcoholics Anonymous and Narcotics Anonymous, and use an interlock device.
• Candelaria Anderson, 42, of Krebs, pleaded guilty Aug. 25 to public intoxication and was fined $10.
• Anderson also pleaded no contest Aug. 25 to domestic abuse assault and battery and a one-year sentence was suspended. She was fined $100 and was ordered to complete 52 weeks of domestic abuse counseling.
• A charge of driving without a driver’s license was dismissed Aug. 25 for Kayla Hilburn, 18, of Krebs. She had obtained a valid driver’s license.
• A charge of malicious injury to property valued at under $2,500 was dismissed Aug. 25 for Jeremiah Lynn Morrison, 27, of Ada.
