Aug. 30, 2008 - Pittsburg County District Court Dispositions

The following felony cases were decided in Pittsburg County District Court Aug. 17-24. Dispositions include dismissed cases, suspended and deferred sentences, and sentences from trials and plea bargains.
• Rayshan Lamar Wise, 35, of McAlester, pleaded guilty Aug. 24 to felon in possession of a firearm, and possession of a controlled substance, marijuana. He was sentenced to six years, to be served concurrent with sentencing in another felony case. A misdemeanor charge of possession of drug paraphernalia was dismissed. The charge was filed with the prior conviction enhancement for a 1995 drug trafficking sentence of 15 years, and a 1999 sentence of five years for possession of a weapon in a penal institution.
• Wise also pleaded guilty Aug. 24 to possession of a controlled substance, marijuana, in the presence of a minor. He was sentenced to six years, to be served concurrent with sentencing in another felony case. Misdemeanor charges of domestic abuse assault and battery and possession of drug paraphernalia were dismissed. The domestic abuse charge was dismissed at the victim’s request, according to the District Attorney’s office. The charge was also filed with the prior conviction enhancement for the trafficking and weapons sentences, as well as a 1994 burglary resulting in a six-year sentence, with another four suspended.
• Dusty Jones, 40, of Hot Springs, Ark., pleaded no contest Aug. 21 to first degree burglary and a seven-year sentence was suspended, on the condition he stay away from any property owned by the victims in the case. Jones was also ordered to have no contact with the victims.
• Daniel Ray Papalia, 24, of McAlester, pleaded guilty Aug. 11 to possession of a controlled substance, marijuana, and misdemeanor driving while his license is revoked. On Aug. 20, judgment and sentencing were deferred for one year, with two weekends to be served in the county jail.
• Katherine Bryant, 42, of Hartshorne, was convicted by jury Aug. 17 of accessory after the fact and sentencing was set for Sept. 23. Jurors heard testimony from three prosecution witnesses and deliberated for less than two hours before returning the verdict and recommending a sentence of five years of probation.
The following misdemeanor cases were decided in Pittsburg County District Court Aug. 18-25. Dispositions include dismissed cases, suspended and deferred sentences, and sentences from trials and plea bargains.
• Adam W. Curry, 26, of Tulsa, pleaded no contest Aug. 25 to driving while his license is revoked and speeding. He was fined $100.
• Alice Pearson, 37, of McAlester, pleaded guilty Aug. 24 to public intoxication and she was fined $10.
• Jason Edward Cooley, 39, of McAlester, pleaded no contest Aug. 24 to driving a motor vehicle while under the influence of alcohol, and speeding. Judgment and sentencing were deferred for one year and he was fined $250. He was also ordered to obtain and comply with the recommendations of a drug and alcohol abuse evaluation within 60 days, and attend DUI school and a Victim’s Impact Panel.
• Jason Lane Routledge, 38, of McAlester, pleaded guilty Aug. 24 to driving a motor vehicle while under the influence of alcohol. Judgment and sentencing were deferred for one year and he was fined $250. He was also ordered to obtain and comply with the recommendations of a drug and alcohol abuse evaluation within 60 days, and attend DUI school and a Victim’s Impact Panel.
• Jason James Levan, 33, of Canadian, pleaded guilty Aug. 24 to public intoxication and he was fined $10.
• Robert H. Thompson, 40, of Wright City, pleaded guilty Aug. 24 to public intoxication and he was fined $10.
• A bogus check charge was dismissed Aug. 24 for Jessica P. Cook, 21, of Indianola.
• A charge of driving while his license is suspended was dismissed Aug. 24 for Charles Lee Mills II, 26, of McAlester.
• A charge of driving while his licenses is suspended was dismissed Aug. 24 for Jeremy V. Jones, 22, of Eufaula, because he had obtained his driver’s license.
• Adam Brent Hayes, 30, of McAlester, pleaded no contest Aug. 21 to driving a motor vehicle while under the influence of alcohol. Judgment and sentencing were deferred for 12 months.
• Marlin Joe Wilson, 39, of McAlester, pleaded guilty Aug. 21 to driving while his license is revoked and judgment and sentencing were deferred for 90 days. He was also fined $100.
• Marcus W. Ford, 21, of McAlester, pleaded guilty Aug. 21 to possession of a controlled dangerous substance, Xanax, without a prescription, and public intoxication. Judgment and sentencing were deferred for one year on the drug charge, and a 30-day sentence was suspended on the intoxication charge, to be served concurrent with sentencing in a separate misdemeanor case. He was also fined $10.
• Ford also pleaded guilty Aug. 21 to driving while his license is suspended and a one-year sentence was suspended, to be served concurrent with sentencing in another misdemeanor case.
• A charge of embezzlement was dismissed Aug. 21 for Matthew Quinn Llewellyn, 27, of Tulsa, pursuant to a Restitution and Diversion agreement with the District Attorney’s office. Restitution in the case has been paid.
• James Ray Snowden, 48, of McAlester, pleaded guilty Aug. 20 to public intoxication and he was fined $10.
• Two counts of bogus check violations were dismissed Aug. 20 for Bobby A. Scott, 43, of McAlester.
• A charge of transporting an opened container of beer was dismissed Aug. 20 for Keevin Edward Cathey, 50, of Hartshorne.
• Carol Billiot, 48, of Kiowa, pleaded guilty Aug. 19 to a bogus check charge and judgment and sentencing were deferred for one year. She was also ordered to pay $1,122.88 in restitution.
• Kenneth D. Roberts, 47, of Quinton, pleaded guilty Aug. 19 to public intoxication and trespassing after being forbidden. He was fined $60.
• William Don Shackelford, 29, of Indianola, pleaded guilty Aug. 18 to driving without a driver’s license and judgment and sentencing were deferred for 90 days.
