Aug. 16, 2009: Pittsburg County District Court Dispositions

The following felony cases were decided in Pittsburg County District Court Aug. 5. Dispositions include dismissed cases, suspended and deferred sentences, and sentences from trials and plea bargains.

• Joseph Thomas Bennett, 20, of McAlester, pleaded guilty Aug. 5 to first degree burglary and knowingly concealing stolen property. He was sentenced to 10 years, with another 10 suspended, to be served concurrent with sentencing in three other felony cases and with credit for time served. The charge was filed with the prior conviction enhancement for 2008 felony convictions for lewd molestation and second degree burglary resulting in a 10-year suspended sentence.

• Bennett also pleaded guilty Aug. 5 to knowingly concealing stolen property and was sentenced to 12 years, with another eight suspended, to be served concurrent with sentencing in three other felony cases. The charge was also filed with the prior conviction enhancement for 2008 felony convictions for lewd molestation and second degree burglary resulting in a 10-year suspended sentence.



The following misdemeanor cases were decided in Pittsburg County District Court Aug. 5-11. Dispositions include dismissed cases, suspended and deferred sentences, and sentences from trials and plea bargains.

• John Wesley Steinbach, 28, of Dallas, pleaded guilty Aug. 11 to possession of a controlled substance, marijuana, driving while under the influence of alcohol, transporting an opened container of beer, possession of drug paraphernalia, and failure to carry insurance or a security verification form. A one-year sentence was suspended and he was fined $330. He was also ordered to obtain an alcohol and drug abuse evaluation and comply with its recommendation, and attend a Victim’s Impact Panel and DUI school.

• Adam Lee Hancock, 28, of McAlester, pleaded guilty Aug. 11 to driving a motor vehicle while under the influence of alcohol and driving without a driver’s license. A one-year sentence was suspended and he was fined $200. He was also ordered to obtain a drug and alcohol abuse evaluation and comply with its recommendations, attend a Victim’s Impact Panel and DUI school within 60 days, and provide proof to the District Attorney.

• Tedd Mott, 42, of Panama, pleaded guilty Aug. 11 to actual physical control of a vehicle while intoxicated, driving while his license is suspended and failure to pay taxes due the state. A one-year sentence was suspended and he was fined $300. He was also ordered to obtain a drug and alcohol abuse evaluation and comply with its recommendations, attend a Victim’s Impact Panel and DUI school within 60 days, and show proof to the District Attorney.

• Fredi Juarez Perez, 22, of McAlester, pleaded guilty Aug. 11 to driving a motor vehicle while under the influence of alcohol, leaving the scene of an accident involving damage and driving without a driver’s license. Judgment and sentencing were deferred for two years and he was fined $300. He was also ordered to obtain a drug an alcohol abuse evaluation and comply with its recommendations, and attend a Victim’s Impact Panel and DUI school within 60 days and provide proof to the District Attorney.

• Johnny Wade Gray, 28, of McAlester, pleaded guilty Aug. 11 to driving while his license is revoked and judgment and sentencing were deferred for six months.

• A charge of driving without a driver’s license was dismissed Aug. 11 for John Wayne Billingsley, 28, of Ashton, Ark., because he is incarcerated in Arkansas and the cost to the county to transport for trial would have been excessive.

• Dennis R. Leadford, 24, of Atoka, pleaded guilty Aug. 10 to driving while his license is revoked. Judgment and sentencing were deferred for one year and he was fined $200.

• Lorraine M. Hoahubi, 39, of McAlester, pleaded guilty Aug. 10 to driving while her license is suspended and she was fined $100.

• John Banks, 37, of McAlester, pleaded guilty Aug. 10 to obstructing an officer and judgment and sentencing were deferred for one year. He was also fined $100.

• Brett Alexander Whinery, 22, of McAlester, pleaded guilty Aug. 7 to making a threatening telephone call and a one-year sentence was suspended, to be served concurrent with sentencing in another misdemeanor case. He was also fined $100.

• Whinery also pleaded guilty Aug. 7 to driving while impaired, attempting to elude a police officer and operation of an ATV on a public roadway. A one-year sentence was suspended and he was fined $210. He was also ordered to seek an alcohol and drug abuse evaluation and to comply with its recommendations within 90 days.

• Andy Lee Horn, 53, of Meadview, Ariz., pleaded guilty Aug. 7 to non-resident fishing without a license. The charge was reduced to resident fishing with no license.

• Justin Ryan Good, 23, of rural McAlester, pleaded guilty Aug. 7 to carrying a firearm while under the influence and judgment and sentencing were deferred for one year. He was also ordered to obtain a drug and alcohol abuse evaluation and to comply with its recommendations within 60 days.

• Breanna M. Gabel, of McAlester, pleaded guilty Aug. 7 to possession of a controlled substance, marijuana, and contributing to the delinquency of minors. Judgment and sentencing were deferred for two years, she was fined $100 and she was ordered to seek a drug an alcohol abuse evaluation within 30 days and to comply with its recommendations.

• A charge of driving while his license is suspended was dismissed Aug. 7 for Daniel Adam Verdadero, 22, of Savanna, because he presented proof of reinstatement.

• Kenneth A. Kinsey, 40, of Kiowa, pleaded guilty Aug. 6 to public intoxication and he was fined $10.

• Richard R. Blackman, 36, of McAlester, pleaded guilty Aug. 6 to driving while his license is suspended. Judgment and sentencing were deferred for 60 days.

• Tammy Diane Little, 39, of McAlester, pleaded guilty Aug. 5 to driving a motor vehicle while under the influence of alcohol/drugs and failure to signal on turning. A one-year sentence was suspended and she was fined $510.

• Hannah M. Dobbs, 20, of Oklahoma City, pleaded guilty Aug. 5 to possession of 3.2 beer by a person under 21. She was fined $10.

• Shella Lynn Turner, 49, of Poteau, pleaded guilty Aug. 5 to transporting an open bottle or container of liquor. Judgment and sentencing were deferred for six months and she was fined $100.

• A charge of domestic abuse assault and battery was dismissed Aug. 5 for Mario Amaro Martin, 29, of McKinney, Texas.
