Pittsburg County District Court Dispositions

The following felony cases were decided in Pittsburg County District Court May 21-22. Dispositions include dismissed cases, suspended and deferred sentences, and sentences from trials and plea bargains.

• Andrew Sinclair Eiklor 29, of McAlester, pleaded guilty May 22 to second degree burglary and judgment and sentencing were deferred for three years. He was also fined $250 and was ordered to pay $635 in restitution.

• Shannon Miller, 26, of Scurry, Texas, pleaded guilty May 22 to bringing contraband drugs into jail and misdemeanor possession of a controlled substance, marijuana, and possession of drug paraphernalia. Judgment and sentencing were deferred for five years and Miller was fined $500.

• Shawn Ronald Sather, 39, of McAlester, pleaded guilty May 22 to possession of a controlled substance, methamphetamine, and misdemeanor possession of drug paraphernalia and failure to illuminate a center high-mount brake light. He was sentenced to nine years in prison, with another nine suspended, to be served concurrent with sentencing in two other felony cases. He was also fined $1,210, and a charge of possession of a police scanner during the commission of a felony was dismissed. The case was filed with the prior conviction enhancement for a 2006 conviction for taking credit card and three counts of unauthorized use of credit card that resulted in a four-year sentence, with another eight suspended; two 2003 convictions for running a roadblock and false personation leading to sentences of three and four years, respectively; and a 1998 conviction for possession of a controlled substance that resulted in a three-year suspended sentence.

• In a separate case, Sather pleaded guilty May 22 to possession of a controlled substance, methamphetamine, within 1,000 feet of a school or park and he was sentenced to nine years in prison, with another nine suspended, to be served concurrent with sentencing in two other felony cases. The case had also been filed with the prior conviction enhancement.

• Kim R. McPhail, 42, of McAlester, pleaded guilty May 22 to possession of a controlled substance, methamphetamine, and misdemeanor possession of drug paraphernalia. A five-year sentence was suspended, to be served concurrently with sentencing in a separate felony case. The charge was filed with the prior conviction enhancement for a 2006 conviction in Osage County, Kan., for possession of opiates, opium or narcotic drugs, resulting in an 11-month sentence.

• In a separate case, McPhail pleaded guilty May 22 to taking a debit card without consent and a five-year sentence was suspended, to be served concurrent with sentencing in another felony case. Restitution in the case was reserved. The case had also been filed with the prior conviction enhancement.

• Andrew Sterling Loar, 24, of Krebs, pleaded guilty May 22 to driving a motor vehicle while under the influence of alcohol. A three-year sentence was suspended, and a misdemeanor charge of transporting an opened container of beer was dismissed. He was also ordered to complete a DUI School and a Victim’s Impact Panel. The first two years of the suspended sentence were to be supervised by Community Sentencing. The charge was filed with the prior conviction enhancement for a 2008 conviction for failure to remain at the scene of an injury accident and operating a motor vehicle involved in a personal injury accident after testing more than .08. Sentencing had been deferred for two years for each count, according to the enhancement filing in the case.

• Joshua Allen Seacrist, 21, of Stillwater, pleaded no contest May 22 to assault and battery upon a police officer, and misdemeanor public intoxication. Judgment and sentencing were deferred for five years on the assault charge, with a condition of the deferral that he serve 67 days in the Pittsburg County Jail. He was also sentenced to 30 days in the county jail on the intoxication charge, to be served concurrently with the assault sentence. A third charge of misdemeanor disturbing the peace was dismissed in the plea bargain agreement.

• Barbara Sue Hurst, 48, of Tulsa, pleaded guilty May 21 to conspiracy to bring contraband into a penal institution, bringing contraband into a penal institution, and misdemeanor bringing contraband into a penal institution. Judgment and sentencing were deferred for three years.

• Bradley S. Grogan, 32, of McAlester, pleaded guilty May 21 to endeavoring to manufacture methamphetamine, possession of a controlled substance, methamphetamine, possession of a controlled dangerous substance without a tax stamp affixed, and misdemeanor possession of drug paraphernalia. He was sentenced to five years, with another 10 suspended, and he was fined $50,000, with all but $1,000 of the fine suspended. Additionally, he was ordered to pay $1,318.35 in restitution. The sentencing was ordered served concurrent with sentencing in a separate misdemeanor case, and the sentencing judge recommended Grogan be assigned to the Keys of Life or an equivalent prison program.



The following misdemeanor cases were decided in Pittsburg County District Court May 19-26. Dispositions include dismissed cases, suspended and deferred sentences, and sentences from trials and plea bargains.

• A charge of obtaining cash or merchandise by bogus check or false pretenses was dismissed May 26 for Tomi N. Taylor, 19, of McAlester.

• Jason D. Murphy, 32, of Deerfield, Mass., pleaded no contest May 22 to aggravated driving a motor vehicle while under the influence of alcohol and judgment and sentencing were deferred for three years. In addition, he was ordered to complete an alcohol assessment, DUI School and a Victim’s Impact Panel.

• Julian Scott Clement, 28, of Haworth, pleaded guilty May 22 to operating a motorcycle without a license and endorsement. Judgment and sentencing were deferred for 30 days and he was fined $50.

• Shawn Ronald Sather, 39, of McAlester, pleaded guilty May 22 to larceny of merchandise from a retailer and he was sentenced to 30 days, to be served concurrent with sentencing in three felony cases.

• Mario Cristwell, 41, of McAlester, pleaded guilty May 22 to driving without a driver’s license and a one-year sentence was suspended. He was also fined $50.

• A charge of violation of a protective order was dismissed May 22 for Frankie Gene Johnson, 28.

• Rendina Recoy, 51, of Savanna, pleaded guilty May 21 to driving without a valid driver’s license, failure to carry insurance or a security verification form and failure to pay taxes due to the state. Judgment and sentencing were deferred for 30 days and Recoy was fined $150.

• A charge of failure to devote full attention to driving was dismissed May 21 for Jackie A. Riley, 28, of Wilburton.

• Shyla Raye Hodge, 22, of Wilburton, pleaded no contest May 20 to transporting an open bottle or container of liquor and judgment and sentencing were deferred for three months.

• Max Carleton Bookout, 46, of Eufaula, pleaded no contest May 20 to domestic abuse assault and battery and a one-year sentence was suspended. Bookout was also ordered to seek 52 weeks of domestic abuse counseling and a second charge of domestic abuse assault and battery was dismissed.

• Ricky Lee Barr, 51, of Quinton, pleaded guilty May 20 to driving without a valid driver’s license and he was fined $200.

• Andre Lamont Crooks, 38, of Oklahoma City, pleaded guilty May 20 to driving without a driver’s license and he was fined $50.

• Fred Dean Ramsey, 43, of Jones, pleaded guilty May 20 to driving while his license is revoked and he was fined $100.

• Fernando Eddie Quiρones, 25, of Wilburton, pleaded guilty May 20 to driving while his license is revoked and failure to use child restraint system. He was fined $110.

• A bogus check charge was dismissed May 19 for Ginger Steward.

• A bogus check charge was dismissed May 19 for Debbie Stiles, of Arkoma.

• A bogus check charge was dismissed May 19 for Angela Stigler, 30, of Eufaula.

• A bogus check charge was dismissed May 19 for Christy L. Steward, of, Eufaula.

• A bogus check charge was dismissed May 19 for Eva L. Sterling, of Dallas.
