PITTSBURG COUNTY DISTRICT COURT LOGS

McALESTER — The following felony and misdemeanor cases were decided in Pittsburg County District Court July 30 - Aug. 6.

Dispositions include dismissed cases, suspended and deferred sentences and sentences from trials and plea bargains.

Listings do not include all court costs.



Felony cases



• Markis Curtis, 21, McAlester, pleaded guilty Aug. 31 to two counts of assault and battery on a police officer. He was fined $1,100 and sentenced to five years, with all but the first 38 days suspended. A charge of unlawful possession of drug paraphernalia was dismissed.

• William Grantham, 19, McAlester, pleaded guilty Aug. 1 to charges of possession of a stolen vehicle, inattentive driving, driving without a driver’s license, failure to carry insurance or a security verification form and petit larceny. He was fined $690, ordered to pay $2,620 in restitution and sentencing was deferred for five years. Charges of driving without a valid driver’s license, failure to carry insurance or a security verification form, failure to pay taxes due state and defective breaks were dismissed.

• James D. Schoggins, 20, McAlester, pleaded guilty Aug. 2 to an application to accelerate a deferred sentence on charges of possession of a controlled drug within 2,000 feet of a school or park, maintaining a place for keeping /selling controlled substances and unlawful possession of drug paraphernalia. He received a five-year suspended sentence.

• Christopher S. McLennan, 24, McAlester, pleaded guilty Aug. 2 to a charge of obstructing an officer. He was fined $100. Charges of possession of a controlled dangerous substance (marijuana) and unlawful possession of drug paraphernalia were dismissed.

• Marshall D. Austin, 19, Quinton, pleaded guilty Aug. 2 to a charge of uttering a forged instrument. He was fined $300, ordered to pay $115 in restitution and received a five-year suspended sentence.

• George Schnexnaider, 50, Savanna, pleaded guilty Aug. 2 to a charge of embezzlement. He was fined $550, ordered to pay $2,666 in restitution and sentencing was deferred for five years.

• Kenneth B. McMath, 27, Kiowa, pleaded guilty Aug. 6 to charges of possession of a controlled dangerous substance (methamphetamine), possession of a controlled dangerous substance (marijuana), knowingly concealing stolen property and malicious injury to property valued less than $1,000. He was fined $1,130 and sentenced to seven years in the custody of the Oklahoma Department of Corrections. Charges of unlawful possession of drug paraphernalia, obstructing an officer and public intoxication were dismissed.

• Billy Joe Barnhill, 36, Haileyville, pleaded no contest Aug. 6 to charges of lewd or indecent acts to a child younger than 16 years of age and second degree burglary. He also pleaded guilty to an application to revoke a suspended sentence on charged of leaving the scene of a personal injury accident and driving a motor vehicle while under the influence of alcohol (aggravated). He was fined $500 and sentenced to 20 years, with 15 years suspended. A charge of lewd or indecent acts to a child younger than 12 years of age was dismissed.



Misdemeanor cases



• A charge of obtaining cash or merchandise by bogus check or false pretenses was dismissed July 30 for Clarissa Lanham, 26, of Eufaula.

• A charge of obtaining cash or merchandise by bogus check or false pretenses was dismissed July 30 for Clarissa K. Neilson, of Checotah.

• A charge of domestic assault and battery in the presence of a minor was dismissed July 30 for Salomon Archuleta, 31, of McAlester.

• A charge of domestic assault and battery in the presence of a minor was dismissed July 31 for Marilyn E. Dages, 34, of McAlester.

• Oakley A. Zuniga, 18, El Reno, pleaded guilty July 31 to a charge of transporting an opened container of beer. He was fined $80 and sentencing was deferred for 30 days.

• Lance P. Baker, 40, McAlester, pleaded guilty July 31 to two counts of public intoxication. He was fined $260 and sentencing was deferred for six months.

• Sandra Shipley, 53, McAlester, pleaded no contest July 31 to a charge of embezzlement. She was fined $280 and sentencing was deferred for one year.

• Tyrell Lee Livingston, 25, McAlester, pleaded guilty Aug. 1 to a charge of transporting an opened container of beer. He was fined $80 and sentencing was deferred for 30 days.

• Roy K. Cloud, 36, Sulphur, pleaded guilty Aug. 1 to charges of possession of a controlled dangerous substance (marijuana) and obstructing an officer. He was fined $960 and sentencing was deferred for one year.

• Christopher W. Ford, 26, McAlester, pleaded guilty Aug. 1 to a charge of transporting an opened container of beer. He was fined $80 and sentencing was deferred for 30 days.

• A charge of domestic assault and battery in the presence of a minor was dismissed Aug. 3 for James R. Hightower, 38, of McAlester.

• Jennifer M. Pink, 27, Hartshorne, pleaded no contest Aug. 3 to an amended charge of assault and battery. She was fined $280, ordered to complete an anger management assessment and sentencing was deferred for three years.

• Melissa A. Wood, 30, Kiowa, pleaded no contest Aug. 3 to charges of driving a motor vehicle while under the influence of alcohol and leaving the scene of a property damage accident. She was fined $980 and sentencing was deferred for one year.

• Charles S. Leeper, 34, McAlester, pleaded guilty Aug. 3 to charges of driving a motor vehicle while under the influence of alcohol and failure to stop at a red light. He was fined $650 and sentencing was deferred for three years.

• Billie Jo Higgins, 39, Krebs, pleaded no contest Aug. 3 to a charge of possession of a controlled dangerous substance. Higgins was fined $1,030 and sentencing was deferred for one year.

• Ruby P. Fulkerson, 74, McAlester, pleaded guilty Aug. 3 to a charge of violation of the Compulsory Education Act. She was fined $25 and sentencing was deferred for 30 days.

• Blake A. Harrison, 24, Haileyville, pleaded guilty Aug. 6 to a charge of driving without a driver’s license. He was fined $230 and sentencing was deferred for 90 days.

• Gregory Goosby, 51, Spencer, pleaded guilty Aug. 6 to charges of driving a motor vehicle while under the influence of alcohol and driving without a driver’s license. He was fined $930, ordered to complete DUI school, ordered to use an interlock device for six months and sentencing was deferred for six months. Charges of unlawful possession of drug paraphernalia and public intoxication were dismissed.

• Norman C. Nunn, 46, Memphis, Tenn., pleaded guilty Aug. 6 to charges of driving a motor vehicle while under the influence of alcohol, transporting an opened container of beer and driving without a valid driver’s license. He was fined $1,460, ordered to complete DUI school, ordered to use an interlock device for one year and received a one-year suspended sentence.



The following new felony cases were filed in Pittsburg County District Court, from Aug. 2 - 7.



• On Aug. 2, Leon Ascue, 71, of Quinton, was charged with driving a motor vehicle while under the influence of alcohol.

• On Aug. 2, Ernest Russell, 53, of Hartshorne, was charged with endeavoring to perform an act of violence, threatening to perform an act of violence and domestic abuse assault and battery.

• On Aug. 3, Chad P. Lusk, 38, of Krebs, was charged with three counts of possession of a controlled dangerous substance and public intoxication.

• On Aug. 3, Weldon L. Shipley, 31, of McAlester, was charged with unauthorized use of a vehicle.

• On Aug. 6, Brittany L. Miller, 22, of Pearce, Ariz., was charged with possession of a controlled dangerous substance (methamphetamine), possession of a controlled dangerous substance (marijuana) and unlawful possession of drug paraphernalia.

• On Aug. 6, Darren L. Sandow, 29, of McAlester, was charged with indecent exposure.

• On Aug. 6, Horace Dean, 37, of McAlester, was charged with falsely personate another to create liability and driving with a canceled, suspended or revoked license.

• On Aug. 6, Leo Gullick Jr., 43, of McAlester, was charged with second degree burglary.

• On Aug. 6, Robert D. Hearst, 31, of McAlester, was charged with child abuse by injury and obstructing an officer.

• On Aug. 6, Greg Stephens, 34, of Quinton, was charged with robbery by force or fear (with firearm).

• On Aug. 7, Holly L. Doak, 31, of Stuart, was charged with possession of a controlled dangerous substance (methamphetamine).

• On Aug. 7, Homer C. Hawkins, 68, of Eufaula, was charged with malicious injury to property valued more than $1,000.

• On Aug. 7, Tommy Lee Nunnelee, 57, of Oklahoma City, was charged with manufacture of a controlled dangerous substance (methamphetamine), unlawful possession of a controlled drug (methamphetamine) with intent to distribute and unlawful possession of drug paraphernalia.

• On Aug. 7, Virginia Lee Cossey, 54, of Hartshorne, was charged with manufacture of a controlled dangerous substance (methamphetamine), unlawful possession of a controlled drug (methamphetamine) with intent to distribute and unlawful possession of drug paraphernalia.

• On Aug. 7, Misty L. Wakefield, 33, of McAlester, was charged with manufacture of a controlled dangerous substance (methamphetamine), unlawful possession of a controlled drug (methamphetamine) with intent to distribute and unlawful possession of drug paraphernalia.
