Pittsburg County district court dispositions
Felony charges
The following felony cases were decided in Pittsburg County District Court Sept. 10-14. Dispositions include dismissed cases, suspended and deferred sentences, and sentences from trials and plea bargains.
• Kevin Wayne Newberry, 36, of rural Wardville, pleaded guilty Sept. 14 to a reduced charge of misdemeanor domestic assault and battery and a one-year sentence was suspended. He was also ordered to seek 52 weeks of domestic abuse counseling. He had originally been charged with felony domestic assault and battery by strangulation in the presence of a child.
• Randy D. Sproles, 30, of McAlester, pleaded guilty Sept. 10 to driving a motor vehicle while under the influence of alcohol and drugs, possession of a controlled substance, methamphetamine and marijuana, and misdemeanor possession of drug paraphernalia. Misdemeanor charges of driving without a driver’s license and failure to pay taxes due the state were dismissed. He was sentenced to 10 years in prison, with another 10 suspended, and he was fined $600. The sentencing was ordered served concurrent with sentencing in another felony case. The charge had been filed with the prior conviction enhancement for Denton County, Texas, convictions for: Forgery financial instrument in 2007 resulting in a nine-month sentence; delivery/manufacture with intent simulated controlled substance, 2003,10 months; DUI, 2002, 23 months probation, revoked to 100 days in 2003; unauthorized use of a vehicle, 1999, 90 days; misdemeanor marijuana possession, 1998 and 1999, 90 and 30 days confinement, respectively; and burglary, 1997, three years probation, revoked to six months in 1998; and a Pittsburg County conviction in 2006 for possession of a stolen vehicle for which a 10-year sentence was suspended.
Misdemeanor charges
The following misdemeanor cases were decided in Pittsburg County District Court Sept. 8-15. Dispositions include dismissed cases, suspended and deferred sentences, and sentences from trials and plea bargains.
• Salissa May Moon, 28, of Antlers, pleaded guilty Sept. 15 to driving with license suspended and a one-year sentence was suspended. The sentencing was ordered served concurrent with sentencing in three other cases.
• Moon also pleaded guilty Sept. 15 to malicious injury to property valued at under $2,500 and a one-year sentence was suspended, to be served concurrent with sentencing in three other cases.
• Troy Glenn Duckworth, 63, of rural McAlester, pleaded guilty Sept. 15 to driving without a valid driver’s license and a 30-day sentence was suspended and he was fined $100. A charge of failure to carry insurace/security verification form was dismissed.
• Richard D. Tabers, 54, of Indianola, pleaded guilty Sept. 15 to driving with license revoked and failure to wear seat belt. A one-year sentence was suspended and he was fined $100 on the license charge. He was also ordered to pay the scheduled fine on the seat belt charge.
• Jessica Dawn Mills, 21, of McAlester, pleaded no contest Sept. 15 to a bogus check charge and judgment and sentencing were deferred for one year. She was also ordered to pay $230 in restitution.
• Naomi Wood, 30, of McAlester, pleaded guilty Sept. 15 to a bogus check charge and judgment and sentencing were deferred for two years. She was also ordered to pay $916.02 in restitution.
• A charge of public intoxication was dismissed Sept. 15 for Gerald Walter Davy, 28 of McAlester.
• Patricia A. Garvin, 58, of McAlester, pleaded guilty July 27 to a bogus check charge and a one-year sentence was suspended on Sept. 14. She was also ordered to pay $436 in restitution.
• Ivan Vaglienty, 25, of Fort Worth, Texas, pleaded guilty Sept. 14 to public intoxication and he was fined $10.
• William Wade Miller, 41, of Reno, Nev., pleaded no contest Sept. 14 to public intoxication and he was fined $10.
• Truman Lance Kenieutubbe, 26, of McAlester, pleaded guilty Sept. 14 to public intoxication and judgment and sentencing were deferred for six months. He was also fined $10.
• A charge of embezzlement of rented property was dismissed Sept. 14 for Byron Miles.
• A charge of possession of drug paraphernalia was dismissed Sept. 14 for Kevin W. Newberry, of Kiowa.
• Brian Hernandez, 22, of McAlester, pleaded no contest Sept. 11 to public intoxication and he was fined $10.
• Charles Lee Bedford, 23, of Hartshorne, pleaded guilty Sept. 10 to failure to stop and remain at scene of property damage accident. He was sentenced to one year, to be served concurrent with sentencing in two other cases, and charges of driving with license revoked, failure to devote full time and attention and failure to carry insurace/security verification form were dismissed. Restitution in the case was reserved.
• A bogus check charge was dismissed Sept. 8 for Rhonda Semeski, of Krebs. Restitution has been paid in full.
