Krebs man gets 10-year suspended sentence for using truck for assault

McALESTER — A Krebs man recently received a 10-year suspended sentence for using his truck in an assault.

Cleveland R. Elliott, 54, pleaded guilty March 1 in Pittsburg County District Court to one felony count of assault and battery with a dangerous weapon.

According to court records, Elliott was charged Dec. 6 with two felony counts of assault and battery with a dangerous weapon after he used his vehicle to strike the vehicle of a woman, who had a 7-year-old child in the car with her.

Elliott pleaded guilty after reaching a plea bargain agreement with the District 18 District Attorney’s Office. As a part of that agreement, one of the two assault charges was dismissed, court records state.

On Nov. 24, Elliott and the woman got into a verbal dispute, according to a police affidavit, and when she attempted to leave, with the child in the car, Elliott “threw a metal water pump at the car ... Elliott picked up the water pump and threw it again at the car breaking the passenger side mirror.”

The woman left the scene, then came back, according to the affidavit. “She drove past the house to a dead end and then turned around and came back to the house,” the affidavit states. “Elliott then pulled out in the road ... blocked the road with his truck and then got out of the truck and started yelling.”

The woman told police Elliott then got back into his truck and rammed her vehicle with the young child still in the car, the affidavit states.

Along with the suspended sentence, Elliott was fined $600 and ordered to complete anger management courses and individual counseling.
