Alderson man charged in New Mexico after being shot by police

McALESTER — An Alderson man has been charged in connection with an officer-involved shooting in New Mexico on Tuesday, officials say.

Kenny Silver, 20, of Alderson, was charged with two felonies in New Mexico, including aggravated assault on police office and fleeing a law enforcement officer, according to New Mexico State Police.

Officers there say they are investigating the case.

Silver was reported missing Sunday from a McAlester motel.

He was last seen at the Comfort Inn and Suites in McAlester on Saturday night when he told his father he would be home around 10 p.m., according to McAlester police Det. Sgt. Chris Morris.

Silver was next found in New Mexico.

New Mexico State Police officer Damyan Brown said at 4:30 a.m. Tuesday, a security guard reported a suspicious vehicle near a railroad yard in Santa Rosa. Brown said  a Santa Rosa police officer pursued the vehicle “ and at the conclusion, shots were fired.”

He said Silvers was shot three times, but the officer was not injured.

Silver was flown to the University of New Mexico Hospital in Albuquerque where he was treated and released to the Curry County Correctional Center. He is being held in lieu of $50,000, according to police there.

Meanwhile, Silver’s stepsister Michelle Martin said Thursday she and other family members were with Silvers on Saturday night at the motel.

“We just got our tax return and we had plans to go to the casino that night,” Martin said.

She said Silvers left the motel with an expensive collector gun worth several hundred dollars.

“I had just bought it at a pawn shop,” Martin said.

She said Silvers suddenly left after receiving a phone call.

“He got a phone call, took my gun and left in our father’s truck,” she told the McAlester News-Capital on Thursday.

She said McAlester police were called when he left with the gun, but she didn’t want to press charges against her brother.

Martin said it was very unusual for Silvers to drive to New Mexico.

“He’s never left this area before,” she said. “Ever.”

Martin said she thinks there could be more to the story.

“I don’t think he was alone when he left,” his stepsister said. “I think he was in danger.”

Meanwhile, New Mexico police say because the case is still under investigation, they could not release further information. Asked if drugs were involved or if Silvers was carrying a weapon, Damyan said he was not able to comment.
