Officials wait for autopsy in deadly boating accident

McALESTER — Officials say they waiting for an autopsy report to determine if charges will be filed in a deadly holiday boating accident.

McIntosh County District Attorney Rob Barris said Friday that Ryan Shumway, 30, of McAlester, made arrangements on Monday to be interviewed by the Oklahoma Lake Patrol. The interview is part of the patrol’s investigation into the death of Gary McIninch, 55, of Oklahoma City, in a July 4 boating accident on Lake Eufaula.

“We know he was present at the time of the accident and he has made himself and his boat available for the investigation,” Barris said of Shumway.

Investigators with the patrol say they are waiting for an autopsy report before concluding the ongoing investigation into the accident.

“It could take weeks or months, for the report,” said Oklahoma Highway Patrol trooper Betsy Randolph.

Shumway was aboard a 1999 Crownline ski boat with three passengers that OHP reports hit two other boats. McIninch’s body was found in the lake two days later, and two girls and another man were hurt in the accident.

McIninch disappeared into Lake Eufaula after he was ejected from a pontoon boat that was hit by the 20-foot ski boat, which had been traveling at an estimated 30 miles per hour, witnesses told police.

After hitting the pontoon, which had been carrying 10 people — including five children — the ski boat landed atop a nearby Stingray boat that had four people on board, according to a report by OHP.

Witnesses told OHP the pilot of the ski boat circled around and asked if everyone was okay and then left the scene, according to the report.

 A 6-six-year old girl suffered a head injury and 7-seven-year-old girl suffered a leg injury in the wreck. Both were flown by medical aircraft to the University of Oklahoma Medical Center in Tulsa and were later released, hospital officials said Tuesday. A man who had been on the pontoon boat was treated on the shore, according to OHP.

Shumway’s attorney William Gotcher said he had no comment  regarding the case. The News-Capital has been unable to contact Shumway.
