UPDATED - Henry, Edmondson say no to Fox

Bill O'Reilly wants District 18 District Attorney Jim Bob Miller’s job. While the controversial talk-show host is at it, he wants District Judge Thomas Bartheld’s job also.

On Friday’s “The O'Reilly Factor,” the outspoken host said he planned to call Gov. Brad Henry Monday.

The controversy is swirling around a sentence handed down to David Earls, a man convicted of raping a 5-year old girl. Bartheld accepted a plea bargain between Earls and Miller's office whereby Earls was sentenced to 20 years in prison with 19 of those suspended. With time served in the county jail, Earls may be free in as little as a few months.

Paul Send, a spokesperson, said a Fox News producer called and asked if Henry could appear on yesterday’s edition of “The O'Reilly Factor.” Sund said the governor declined the invitation due to “scheduling conflicts.”

A call to the governor's office this morning was not returned.

A Fox News producer also called Oklahoma Attorney General Drew Edmondson’s office and ask if the AG would be available to appear on “The O’Reilly Factor” sometime this week.

According to Charlie Price, a spokesperson for the AG, Edmondson’s office said no, citing scheduling conflicts.

On his show Monday, O’Reilly implied that both Henry and Edmondson were ducking him by not appearing.

“That’s not accurate,” Price said. He said the producer did say the topic would be “that case in McAlester," but the AG's office still declined to appear.

Price said the AG’s office isn’t involved in the David Earls case.

Under Oklahoma law, the attorney general has no jurisdiction over the state’s 27 district attorneys.

When asked if the AG’s office had received any complaints or phone calls about the Earl’s case, Price said “we’ve had a few calls today.”
